Terms and Conditions of Use

These Terms and Conditions ("Terms") govern your access to and use of the NC Results Management System provided by Nandroid Computing.

By accessing or using the Software, you acknowledge that you have read and understood these Terms and agree to be bound by them, subject to applicable law.

1. User Obligations

The Software shall be used strictly for lawful educational and administrative purposes.
Users are responsible for safeguarding their login credentials and preventing unauthorized access to their accounts.
Schools and authorized users are responsible for ensuring that information entered into the system is accurate, complete, and up to date.
Users shall not misuse, interfere with, damage, or attempt to exploit the Software or its security features.
Users shall not attempt to gain unauthorized access to another user's account, school records, or system data.
Users must promptly notify Nandroid Computing of any suspected unauthorized access or security incident.

2. Fees and Payment

Access to the NC Results Management System is subscription-based and subject to the applicable subscription fees agreed upon with Nandroid Computing.
Schools are responsible for renewing their subscriptions before the expiry date to avoid interruption of service.
A K500 reconnection fee shall apply to clients who make payment after their subscription has expired, subject to any alternative arrangement expressly approved by Nandroid Computing.
Payment must be made using the payment arrangements approved or communicated by Nandroid Computing.
Any special payment arrangement, discount, or deferred-payment agreement must be expressly approved by Nandroid Computing.

3. No Free Trials and Special Payment Arrangements

Nandroid Computing does not offer free trials of the NC Results Management System. Access to the Software is provided on a paid subscription basis.
However, under special circumstances, Nandroid Computing may, at its sole discretion, permit a school to use the Software before completing payment, subject to an approved payment arrangement.
Such permission is an exceptional arrangement and shall not be interpreted as a free trial, a waiver of subscription fees, or an entitlement to use the Software without payment.
Schools seeking access before renewal or payment must negotiate the arrangement with Nandroid Computing in good time, preferably before the existing subscription expires.
Where early access or deferred payment is approved, the school shall provide a formal written commitment letter on its official school letterhead. The letter must be properly dated, officially stamped, and signed by an authorized school representative.
The commitment letter must clearly state the school's commitment to pay the applicable fees and specify the agreed payment date.
Submission of a commitment letter does not automatically guarantee approval. Access before payment or renewal shall only be granted after Nandroid Computing has approved the arrangement.
Nandroid Computing reserves the right to approve or decline requests for deferred payment or early access. Approval on one occasion does not guarantee approval of similar requests in the future.
Failure to honour an agreed payment commitment may result in suspension or restriction of access until the outstanding payment is settled or another arrangement is approved.

4. Changes to These Terms and Conditions

Nandroid Computing reserves the right to amend, update, or revise these Terms and Conditions from time to time to reflect changes in the Software, services, business practices, operational requirements, or applicable laws.
The latest version of these Terms and Conditions will be published on this page. The "Last Updated" date at the bottom of the page will indicate when the Terms were most recently revised.
It is the responsibility of every school, administrator, teacher, and other user of the NC Results Management System to check this page regularly for changes and updates.
Users are encouraged to review these Terms periodically to remain informed of their rights, responsibilities, and any changes affecting the use of the Software.
Where a change materially affects users' rights or obligations, Nandroid Computing may provide additional notice through the Software, email, or other appropriate communication channels.
Any revised Terms shall take effect from the date stated in the updated Terms or the date communicated by Nandroid Computing, subject to applicable law. Continued use of the Software after the effective date may constitute acceptance of the revised Terms where permitted by law.

5. Intellectual Property

The NC Results Management System, including its software, source code, design, branding, and associated materials, remains the intellectual property of Nandroid Computing or its respective rights holders.
Access to the Software does not transfer ownership or intellectual property rights to any school, user, or other party.
Users shall not copy, reproduce, modify, distribute, reverse-engineer, or commercially exploit the Software without prior written authorization, except where permitted by applicable law.

6. Limitation of Liability

Nandroid Computing will make reasonable efforts to maintain the availability and proper functioning of the Software. However, uninterrupted or error-free service cannot be guaranteed.
Temporary interruptions may occur due to maintenance, technical faults, internet connectivity problems, hosting-provider issues, or circumstances beyond the reasonable control of Nandroid Computing.
Schools are responsible for reviewing the accuracy of information entered into the system and maintaining appropriate backup records of important educational and administrative information.
To the extent permitted by applicable law, Nandroid Computing shall not be liable for indirect or consequential losses arising from the use of, or inability to use, the Software.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law.

7. Suspension and Termination

Nandroid Computing may suspend or restrict access where a subscription expires, payment obligations are not met, or these Terms are materially breached.
Access may also be suspended where reasonably necessary to protect the security, integrity, or proper operation of the Software.
Where appropriate and reasonably practicable, notice may be provided before suspension or termination.
When a subscription expires or access is terminated, the user's right to access the Software may cease, subject to any approved extension or other written arrangement.

8. Privacy and Data Protection

Personal information and other data handled through the NC Results Management System are subject to our Privacy Policy.

Schools and authorized users are expected to handle learner, parent, teacher, and other personal information responsibly and only for legitimate educational or administrative purposes.

9. Governing Law

These Terms and Conditions shall be governed by the laws of the Republic of Zambia, subject to applicable legal requirements.
